Has an error on your Tenant Screening Report disqualified you from renting an apartment?

Renting can be precarious at the best of times … finding the right place, at the right price, in the right location, can be stressful and time consuming.  The last thing you need, once you’ve found a place to call home, is being rejected by Tenant Screening Report errors.  What’s the first thing you need to know?  You need to know that you have rights and how to protect them.   Going it alone against multibillion dollar entities like Equifax, Experian and TransUnion (the three main Credit Bureaus), each of whom have their own Global Legal Team, is possible but definitely inadvisable.  We recommend contacting a Credit Report specialist as soon as you detect an error in your Tenant Screening Report.

Why do I need a Lawyer for my Tenant Screening Report Issue?

Credit Report attorneys specialize in the intricacies and nuances set out by the Fair Credit Reporting Act (FCRA), Federal and State laws combined with experience facing corporate giants and their network of legal experts. When examining the power dynamic between business interests and consumer rights, you see that Consumer Protection Law, the umbrella under which Tenant Screening Reports and Credit Report Law falls, covers myriad aspects of consumer protection.  In other words . . . a Credit Report attorney’s main goal is to protect you, the consumer.

How Do Tenant Screening Report Errors Affect My Ability to Rent an Apartment?

Most landlords will run a credit check on prospective tenants; it makes sense, they want to see what kind of risk they’re taking with their property.  If there are problematic issues on your Tenant Screening Report it is unlikely a landlord will risk agreeing to give you a lease or allow you to occupy the property without one.  You could potentially find yourself in a very hazardous situation if no one agrees to rent you a place to live.  At best you are vulnerable to charlatans who will charge exorbitant rents and leave you in a highly precarious and distressing situation.  Worse still, you could find yourself homeless.  All due to errors caused through no fault of your own.  The good news is that you have rights.  Better yet, there are Legal Specialists available, at no cost to you, who can expediently have the errors corrected and ensure, when applicable, that you are properly compensated for any financial losses/expenses directly caused by the error(s) and for emotional distress suffered.

How Does an Error Occur on My Tenant Screening Report?

Companies that check the backgrounds of rental applicants may be individual businesses or branches of larger Credit Reporting firms. Companies that create Tenant Screening Reports use algorithms to collect, sort, and handle information about their clients. When information about a specific application is collected and put together, a Tenant Screening Record is made. The report usually includes rental and eviction history, credit history, court appearances, criminal records, bankruptcies, sex offender status etc. Each Tenant Screening Report includes Rating or Score. A Tenant Screening Report helps landlords and property management companies decide if a potential tenant will follow through on their lease responsibilities, damage or abandon the property, pay rent on time, need to be evicted, and so forth.  So . . . you need to be sure that your Tenant Screening Report only reflects your information and isn’t tainted by someone else’s information.

What are My Rights as a Tenant?

The main Federal body that controls the consumer data business is the FCRA. Consumer Reporting Agencies (CRAs) collect, process, and share consumer information. CRAs collect information from the businesses you deal with: banks, Credit Card companies, mortgage lenders, auto loan companies, service providers, and so forth. CRAs also collect data via City, County and State records.

Here are a few of the basics:

  • The FCRA states that it is illegal to run a Tenant Screening Report without your permission.
  • You have the legal right to have your information treated in a way that gives a true picture of you as a consumer.
  • The right access your  Tenant Screening Report.
  • You have the right to know exactly what information in the Tenant Screening Report was used to turn down your rental application.
  • You can obtain a free copy of your Tenant Screening Report in three ways: at annualcreditreport.com, over the phone at 877-322-8228, or by sending in the form at annualcreditreport.com. Other sites may not be secure, you should only use the link provided.
  • The right to challenge details in your report that are incorrect, misleading, or incomplete.
  • The right to file a lawsuit and demand that mistakes be corrected and, when applicable, you have the right to compensation.
  • The CRA will pay your legal fees if you win a case against them.

What can the Tenant Screening company be Held Accountable for?

They must follow “reasonable procedures to assure maximum possible accuracy” when gathering and sharing information. The companies are legally required to do everything they can to produce correct, legally reportable, clear information that paints a true picture of you, the consumer.

  • They must provide you a way to challenge incorrect data.
  • They must properly, effectively, and adequately look into any information that is being challenged.
  • They must fix the mistakes in your report.
  • If you win a case, they must compensate for your losses and emotional distress.
  • If you win, they must pay your lawyers’ fees and court costs. Even if you lose the case, there will be no cost to you whatsoever.

What to Do If Your Tenant Screening Report has Errors

Take action immediately and set the process in motion to rectify the errors.

  • Inspect your Tenant Screening Report, make a detailed list of all errors.  Be sure to check Equifax, Experian and TransUnion.
  • Check your Credit Record from all three Credit Bureaus. It’s possible that the mistakes occurring in your Tenant Screening Report are also occurring in other reports.
  • Contact an experienced Credit Report attorney.  As mentioned above, it is possible to personally dispute Tenant Screening Report Errors, however, it isn’t advisable. If you do attempt to take on these corporate giants alone, we suggest that you file the claim and send proof through certified mail, making sure to keep meticulous records and receipts.  You will need to familiarize yourself with the FCRA and all associated Federal and State laws and research cases similar to your own in order to attempt receiving the compensation, where applicable, you deserve.

What Will My Lawyer Do for Me?

Credit Report (Consumer Protection) lawyers are litigators and advocates who fight for your right to fair and accurate Credit Reporting. They will help you get rid of the mistakes in your Tenant Screening and other Credit Reports, reestablish a correct financial status, and ensure you receive proper compensation for your losses and suffering.

What About “Credit Repair” agencies?

These agencies may be scams . . . you pay them a fee to repair your Credit Reports but there are no binding contracts that force them to do so once you have paid the fee.

How Much Will a Lawyer Cost Me

You don’t pay anything. The company we sue pays all legal fees.

Will I Get Monetary Compensation for Mistakes on My Tenant Report

If the mistakes hurt you financially and/or emotionally you are entitled, by law, to monetary compensation. In some instances, you may be eligible for compensation even if you haven’t suffered any losses.  Only an experienced Credit Report Legal Expert will be able to fully evaluate your situation and obtain the fullest results..
